Justice Department officials have emphasized that prosecuting a sitting president may violate the separation of powers. They point to a 2000 memo from the Office of Legal Counsel that outlines the potential conflicts arising from such prosecutions.
This memo argues that the necessary investigation of a sitting president could disrupt the essential functions of the presidency.
